The rules

How it works.

This applies regulation 10 of the Conduct of Employment Agencies and Employment Businesses Regulations 2003. In short:

  1. The choice. A transfer fee can only be enforced if your terms let the client choose a further period of hire instead of paying it.
  2. The relevant period. No fee is due if the worker starts with the client after the later of these two: 14 weeks from the first day they worked for the client, or 8 weeks from the day after the last day they worked there.
  3. The 42-day gap. If there was a gap of more than 42 days when you weren't supplying the worker to that client, the 14 weeks count from the first day after the gap.

One consequence surprises people: if the temp moves straight into the perm job, they start within 8 weeks of their last day by definition, so a fee is chargeable however long they've been with the client, as long as your terms offer the extended hire.

Leave the end date blank if they're still on assignment. We take their last day as the day before the perm start.

A guide, not legal advice. It applies the rules as written to the dates and figures you enter. Your own terms and the facts of a case can change the answer; if money or a dispute turns on it, check with an employment lawyer.
